BBO Affiliate Programme – Terms and Conditions

These Terms and Conditions ("Terms") govern participation in the BBO Affiliate Programme ("Programme "). By applying to or participating in the Programme , you ("Affiliate", "you") agree to be bound by these Terms.

These Terms are intended to comply with New Zealand law, including the Contract and Commercial Law Act 2017, Fair Trading Act 1986, Consumer Guarantees Act 1993 (where applicable), and Privacy Act 2020.

1. Definitions

• "BBO", "we", "us", "our" refers to BBO and its operators.

• "Affiliate" means an individual or entity approved to participate in the Programme.

• "Affiliate Link" means a unique tracking link provided to an Affiliate.

• "Commission" means the agreed monetary reward for Qualifying Referrals.

• "Qualifying Referral" means a customer who completes an eligible purchase through a valid Affiliate Link, subject to these Terms.

• "PayPal Account" means a valid, active PayPal account capable of receiving payments.

2. Eligibility

2.1 - The Programme is open to individuals and entities worldwide.

2.2 - Affiliates may be under 18 years of age, provided that:

• they hold a valid PayPal account in their own name or one they are legally authorised to use; and

• they have the legal capacity to receive payments via PayPal.

2.3 - By participating, you warrant that you are legally permitted to enter into this agreement or are otherwise legally able to receive payments.

2.4 - We reserve the right to refuse or terminate any Affiliate application at our sole discretion.

3. Affiliate Obligations

3.1 - Affiliates must promote BBO in a lawful, honest, and ethical manner; using only approved BBO Marketing Material.

3.2 - Affiliates must not:

• make false, misleading, or deceptive claims about BBO, its products, or services;

• engage in spam, unsolicited messaging (DM Advertising), or deceptive marketing practices;

• impersonate BBO or represent themselves as an employee, partner, or owner;

• violate any applicable laws, regulations, or platform rules.

4. Tracking and Referrals

4.1 - Referrals are tracked using Affiliate Links and cookies.

4.2 - A referral will only be considered a Qualifying Referral if:

• the customer clicks the Affiliate Link before purchasing; and

• tracking is successfully recorded by our system.

4.3 - We are not responsible for tracking failures due to browser settings, ad blockers, network issues, or user actions.

5. Commissions

5.1 - Commission rates, payout thresholds, and eligible products or services will be communicated separately and may be updated from time to time.

5.2 - Commissions are only earned on completed, paid, and non-refunded transactions.

5.3 - We reserve the right to withhold or reverse commissions for:

• refunded, disputed, or fraudulent transactions;

• self-referrals;

• breaches of these Terms.

6. Payments

6.1 - Payments are made exclusively via PayPal.

6.2 - Affiliates are responsible for ensuring their PayPal account details are accurate and able to receive funds.

6.3 - Any fees charged by PayPal are the responsibility of the Affiliate.

6.4 - Affiliates are solely responsible for any tax obligations arising from commission payments, including income tax obligations under New Zealand law or their local jurisdiction.

6.5 - A minimum balance of $5 USD must be earnt before being eligible for payments. 

6.6 - Payments are processed within the first 5 days of a new month. Delays may occur; affiliates will be kept updated in the Affiliate Discord Server.

7. Taxes

7.1 - Commissions are paid exclusive of any taxes unless otherwise stated.

7.2 - Affiliates are responsible for declaring and paying any applicable taxes, duties, or levies.

7.3 - BBO does not provide tax advice.

8. Intellectual Property

8.1 - BBO grants Affiliates a limited, non-exclusive, revocable licence to use approved branding and marketing materials solely for Programme participation.

8.2 - Affiliates must not modify BBO branding without prior written approval, which may be obtained through a Support Ticket.

8.3 - All intellectual property rights remain the property of BBO.

8.4 - Violation of BBO IP will result in immediate termination from the Affiliate Programme.

9. Termination

9.1 Either party may terminate participation in the Programme at any time, with or without notice.

9.2 Upon termination:

• all licences granted under these Terms immediately cease; and

• unpaid commissions may be forfeited if termination results from a breach of these Terms.

10. Limitation of Liability

10.1 - To the maximum extent permitted by New Zealand law, BBO is not liable for any indirect, incidental, or consequential loss arising from participation in the Programme.

10.2 - Our total liability in connection with the Programme is limited to the total commissions paid to the Affiliate in the preceding three months.

11. No Guarantee of Earnings

11.1 - Participation in the Programme does not guarantee any level of income or earnings.

11.2 - Earnings depend on factors beyond our control, including Affiliate effort and market conditions.

12. Privacy

12.1 - Personal information collected from Affiliates will be handled in accordance with the Privacy Act 2020.

12.2 - Affiliates consent to the collection and use of their information for Programme administration and payment purposes.

13. Changes to Terms

13.1 - We may update these Terms at any time.

13.2 - Continued participation in the Programme constitutes acceptance of updated Terms.

14. Governing Law

14.1 - These Terms are governed by and construed in accordance with the laws of New Zealand.

14.2 - Any disputes will be subject to the non-exclusive jurisdiction of the New Zealand courts.

15.1 - Built by Oochya's Support Team may be contacted directly via the official BBO Discord Server's Ticket System. 

15.2 - Participants of the Built by Oochya Affiliate Programme agree to these Terms and Conditions.
